1           The Quill Consultancy is the registered trading name of The Quill Consultancy Pty Ltd (ABN: 23 081 084 924) located at 34 Patrick Street, Hobart, Tasmania, Australia. The Quill Consultancy is hereinafter referred to as “The Quill”. The Quill may be contacted on +61 3 6231 0577.

2    A visit to The Quill website may result in anonymous gathering of information for statistical and site management purposes. The information that is potentially recorded includes your server address, your domain name, the date and time of your visit to the site, the pages accessed and any documents downloaded, the previous site you visited and the type of browser you are using. No attempt will be made to identify users or their browsing activities except where required by law.

3    This website does not use cookies. (Cookies are usually small text files that are stored on your computer that can be read by the website that created them to recall information that the user has entered. Cookies can be either "persistent" or "session" based. Persistent cookies are stored on your computer and contain an expiration date whereas session cookies are destroyed when you close your browser and no personal information is maintained which might identify you should you visit our website at a later date.)

4    The Quill collects personal information as provided by the user for the purposes of providing the training and consulting services it offers. The type of information that is stored relates to the activities of The Quill, in particular training programs and consulting services that are offered ("the services"). This would ordinarily include details such as information pertaining to the identity of the user such as name, address, contact numbers, email and the like; in addition to preferred training courses or services. By utilising The Quill and providing personal information to it the user consents to the collection and reasonable use by The Quill of the user’s personal information. The Quill will take all reasonable steps to ensure that information given to The Quill by users is afforded privacy and maintained in a confidential and secure manner consistent with the provision of the services.

5    The Quill does however require that the information provided by the user be accurate and pertinent to its purposes.

6    While The Quill shall use its best endeavours to ensure any personal information of a user that it records is accurate and up-to date, it is the obligation of the user to ensure that any personal information provided by the user is precise and correct and to notify The Quill of any inaccuracy the user is aware of. The Quill accepts no liability for any transmitting of information to an authorised third party that occurs as a result of incorrect information being provided to it or the user failing to up-date any such information.

7    Only authorised servants or agents of The Quill will have access to that information for the primary purposes of performing the services pertaining to the user. The user nevertheless accepts that some of the information provided might also be utilised for The Quill’s secondary purposes such as statistical surveys but only where such information is in aggregated form where the identity of the user remains anonymous. The Quill may provide such aggregated information to third party organisations providing analytical or marketing services.  The Quill will not use or disclose personal information to third parties or for the purposes of direct or mass marketing without obtaining the user’s express prior consent.

8    Notwithstanding the above, a law enforcement agency or other government agency may exercise its legal authority to inspect our logs and databases.

9    The user will be able to access any information that it has provided to The Quill in accordance with the provisions of National Privacy Principle 6 of the Privacy Act.  Such access may be obtained upon request by contacting The Quill directly on +61 3 6231 0577 or in writing to The Quill Consultancy Pty Ltd, GPO Box 1793, Hobart, Tasmania, Australia 7001.

10   This site provides facilities for the secure transmission of any information that we may collect on this web site. Nevertheless, users should be aware that there are inherent risks transmitting information across the Internet.

11   The Quill reserves the right to change its Privacy Statement in the future. Any changes to The Quill’s Privacy Statement will be published on this website. Continued use of the website after alterations are made will be considered acceptance of the changes made.

Terms and Conditions for use of this site

The user of this website acknowledges and agrees to be bound by these Terms and Conditions, including this introductory paragraph, the Privacy Statement, any Disclaimers or ancillary terms which exist in this website.

These Terms and Conditions apply to all users and access to this website or any part of it is permitted in consideration of and subject to the user abiding by them.

1    User’s obligations

1.1      Any person using the website must do so in a responsible fashion and in good faith.

2    User’s limitations

2.1      The user agrees not to:

2.1.1     use this website to transmit any information or material which is illegal, infringes third party rights or contravenes any relevant codes or standards

2.1.2     use this website to transmit any information that is slanderous, libellous, disparaging, harmful, threatening, menacing, offensive or restricts any other person’s use and enjoyment of this website

2.1.3     use another person’s username, identity, password or other name or provide The Quill with any false or inaccurate information

2.1.4     transmit, incorporate or otherwise transpose onto this website any obscene, pornographic, indecent, racially or otherwise discriminatory material, or any defamatory or other material the transmission or publication of which may amount to a criminal offence or civil breach in any Australian or any other jurisdiction

2.1.5     alter, embellish, damage or misuse or otherwise interfere with the operation of the website whether achieved by hacking or by any other means

2.1.6     introduce any virus, element or medium that could interfere, disrupt or damage the website and/or its contents

2.1.7     infringe the intellectual property including any trade marks or copyright material of The Quill consultancy or any person whether by transmission, incorporation or other transposition of such information onto or from this website or any other medium

2.1.8     link or frame any of The Quill’s website without the express, written prior permission of The Quill (enquiries regarding linking may be directed to The Quill on +61 3 6231 0577).

2.2      Any illegal or suspected illegal act of a user or a user account in relation to the access or use of this website comes to the attention of The Quill will be reported to the responsible prosecuting authorities.

3    Third parties and information provided by third parties

3.1      Some of the material provided on this website is supplied by Third Parties.  The Quill has neither assessed the accuracy of the information nor the quality nor the appropriateness of the Third Party information or material provided for the user. The Quill does not warrant, endorse or make any representation as to any of the content or accuracy of any Third Party information and accordingly accepts no responsibility for such information or material.  The user hereby acknowledges and agrees that The Quill is not liable to the user for any loss or damage howsoever arising in respect of such information or material including any loss or damage arising by way of negligence.

3.2      Before relying on any Third Party information it is the responsibility of the user to check with the Third Party as to accuracy, suitability and quality of the information provided.  The user hereby acknowledges and agrees that the user has not relied on any representation, warranty or endorsement by The Quill in respect of any third Party information or material.

3.3      If the user relies upon any information provided by a Third Party then the user does so at his, her or its own risk and accepts that the legal relationship is with the Third Party supplier and not with The Quill.

3.4      The Quill does not receive payment from Third Parties for services displayed or made available by the website or made accessible by a link on the website.

3.5      If The Quill has provided a link to a Third Party website then The Quill is not responsible for the availability, quality, standard, merchantability or suitability to the user’s purposes of the goods, services or resources associated with that link and makes no representation as to, warranty or endorsement of the goods services or resources offered in association with such link.  The user hereby acknowledges that any such link is provided for its convenience only.

4    Registration

4.1      In order to register for the provision of services such as training, the user will need to provide an email address and possibly utilise a password in order to access various sections of the website. The user will be requested to provide personal information such as name and personal contact details. The user agrees and consents to The Quill using this information for communication relating only to the provision of the particular service for which it is provided.

4.2      The user only agrees and consents to The Quill forwarding communications such as regular newsletters and the like to the user by email if the user elects to opt into receiving such information by selecting the newsletter checkbox in any registration dialogue box or on-line form that is provided.

5    Security

5.1      Re-authentication of your details may be required of you in the interests of security.  The Quill will not be liable for any information which may be lost if a user’s browser session is terminated due to a long period of inactivity between the user’s browser and the website or any failure of connection by any other cause.

5.2      Upon registration by a user, The Quill will assign a unique identifier for each user which, in conjunction with the user’s email address, password (if required) and name, will constitute the primary security measure for access to services provided on or via the website.

5.3      Users who elect to register are required to keep any passwords and any unique identifier assigned by The Quill secure and confidential at all times.

6    Alterations

6.1      The Quill may alter these Terms and Conditions at any time. Any revisions of the Terms and Conditions will be published on the website. Continued use of the website after alterations are made will be considered acceptance of the changes made.

7    Termination, suspension and limitation of use

7.1      If in the reasonable opinion of The Quill a user breaches any of these Terms and Conditions or otherwise acts in a manner inconsistent with the spirit of them then that user’s access to the website may be terminated, suspended or limited immediately and without notice.

8    Intellectual property: copyright, trade marks, patents and confidential information

8.1      All material on the website is the intellectual property of The Quill, save for any separate and independent intellectual property that is published or otherwise communicated to the public or the user on the site by any Third Parties or any material stated to be specifically exempted. The Quill retains its rights to all intellectual property in which it has an interest associated with the website including copyright in all information and material and its rights in any trade marks or confidential information communicated to the public or the user or published on, integrated with or incorporated into the website. The Quill’s material is protected by Australian and international copyright laws. The user hereby agrees to respect and abide by the intellectual property rights of The Quill and any Third Parties.

8.2      The user will not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this content in any way except as expressly provided for on the Website or expressly authorised in writing by The Quill or the relevant third party owner or rights holder.

8.3      The user agrees not to reproduce, distribute, transmit, publish or otherwise transfer, or commercially exploit content from websites, to which access was made possible by The Quill website

8.4      The user irrevocably licences The Quill without restriction to reproduce, adapt, translate or communicate to the public or otherwise use or display any materials and/or trade mark transmitted to, posted or otherwise provided by the user to The Quill in accordance with and subject to these Terms and Conditions and the Privacy Statement.  To the extent necessary the user hereby expressly waives any moral rights pertaining to such materials or information provided by the user to The Quill in relation to uses made of such information by The Quill in providing the services or fulfilling its purposes as contemplated in these terms and conditions.

8.5      “Material” is that material as defined in the Terms and Conditions.

9       Governing law

9.1      The user irrevocably agrees that the governing law of this agreement and the use of The Quill’s website and services is and shall be the law applying in Tasmania, Australia from time to time.  Further, the user agrees to submit irrevocably to the jurisdiction of the Tasmanian legal forums for the determination of any dispute which may flow from this agreement; save for disputes which may be governed by any relevant Federal legislation that requires such matters to be heard in a legal forum with Federal jurisdiction.

10       Severability

10.1    If any or part of these Terms and Conditions is or are void or voidable or is or are otherwise not able to be enforced then such part will be severed and the remaining terms will continue to be in force.

11       Inaction

11.1    Inaction, waiver or acquiescence by The Quill in relation to any breach or breaches of these Terms and Conditions does not constitute a waiver of The Quill’s right to act in relation to future or similar breaches or operate as a bar to The Quill’s rights to act in relation to the breach or breaches concerned.

12       Indemnity

12.1    If The Quill suffers any loss or damage or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation then the user agrees to indemnify The Quill for those losses, damages and costs.

13       Definitions

In these Terms and Conditions:

user is any person whether natural or corporate who uses this website. This means you.

use of this website constitutes acceptance of these Terms and Conditions and includes any conceivable use or deployment of whatsoever nature including but not limited to browsing, touring, examining, searching for, downloading, copying or reading information provided by this website, including accessing services/products/information whether by payment or gratuitous access.

Hotlink or link is a direct link to another web page which is reached by clicking on a specified word or phrase highlighted in the subject text and identified as a route to another web page.

framing is the process of presentation remotely in an altered, modified or augmented fashion of any webpage or part thereof of the website of The Quill

The Quill is construed to be read interchangeably with The Quill Consultancy and The Quill Consultancy Pty Ltd.

material includes articles, essays, commentaries, text, graphics, logos, sounds, music, animation, portal or website design or architecture, operating systems or methods and any associated or underlying code or computer program.

person is construed to mean all persons regardless of whether they are natural or corporate.

Any expression connoting the singular or plural shall be read and construed as connoting either or both as required or according to the applicable circumstances.
